CGHS HOSPITALS UNDER SURVEILLANCE BY THE AEGIS OF CGHS OFFICER TO CHECK IRREGULARITIES INCLUDING EXPLOITATION OF PATIENTS

While replying to a question in Parliament today, Minster of Health & Family Welfare Shri Jagat Prakash Nadda said that to ensure that the terms and conditions of the Memorandum of Agreement are followed scrupulously by the empanelled hospitals, a monitoring cell under the aegis of a senior officer of CGHS has been established to check irregularities including exploitation of patients”,

Treatment by CGHS empanelled hospitals in emergency cases

Recently, the Government has amended the terms and conditions for empanelment of private hospital under the Central Government Health Scheme (CGHS). Now, the hospitals are empanelled as a whole, meaning that all facilities available in the hospital would be provided to CGHS beneficiaries. Disease – specific empanelment has now been stopped.

To ensure that the terms and conditions of the Memorandum of Agreement are followed scrupulously by the empanelled hospitals, a monitoring cell under the aegis of a senior officer of CGHS has been established to check irregularities including exploitation of patients. There are provisions in the MoA including issue of Show Cause Notice, issue of warning, recovery of amount charged illegally from the beneficiaries, also confiscation of part or whole of PBG (Performance Bank Guarantee), and ultimately removal from the CGHS list, that can be resorted to in appropriate cases

Measures taken by the Govt. to overcome the Inconvenience caused to Beneficiaries due to Shift in Treatment Policy of CGHS



With a view to plug the loopholes in the system, the Government decided on 25.8.2014 that only CGHS formulary medicines and those approved by Drug Controller General of India (DCGI) in India would be provided to beneficiaries under CGHS. The maximum period of issued medicines was also curtailed to one month instead of three months. It was decided ibid that only listed investigations/treatments at prescribed CGHS rates would be allowed.

The following measures have since been taken to overcome the inconvenience caused to the beneficiaries due to this shift in policy:

(i) The Government decided to adopt formularies of Ex- Servicemen Contributory Health Scheme (ECHS) and Employees State Insurance Corporation (ESIC) also in addition to the existing CGHS formulary.
(ii) A technical committee under Chairmanship of Special DG has been constituted to consider inclusion/exclusion of medicines/ investigation/treatment/procedures /implant etc.

(iii) A Group of experts has been constituted on 25.9.2014 to review CGHS formulary to avoid denial of essential medicines to CGHS beneficiaries and revising the formulary.

(iv) Instructions have also been issued to CMOs In-charge vide Office Memorandum No. 2-2/2014/CGHS/PPT/CGHS-P dated 1.10.2014 to use their discretion to supply essential medicines to CGHS beneficiaries even though they do not figure in the formularies of CGHS/ECHS/ESIC.
(v) The Government also extended further relaxation to the beneficiaries by switching back to the previous arrangement regarding time period of issued medicines i.e. 3 months for chronic disease and 6 months in case of visit abroad.

Dear Colleagues,
National Council (Staff Side) JCM for Central Government employees demanded and submitted a memorandum on Interim Relief and Merger of DA to the 7th CPC and also to the Ministry of Fiance. A reply has been received by the Secretary (Staff Side) National Council (JCM) from Ministry of Finance which is indicative of a refusal of both the demands. The 7th CPC have so far not communicated to us the decision they have taken on the memorandum submitted by the Staff Side, National Council (JCM).
The NDA Government has adopted the same plea made by the UPA II Government to reject our demands.
From the steps so far taken by the BJP Government, it is unambiguous that they would be pursuing the neo-liberal economic policies with much more intensity than even the UPA Government. Having got a clear majority in the Parliament, they would be able to push through necessary legislations to pursue reforms. The outsourcing of Railway functions, privatisation/Corporatisation of Defence manufacturing units, increased FDI inflow in various core sectors of economy, dismantling of the administrative price mechanism, de-nationalisation efforts in the Banking, Insurance and coal sectors and above all the adherence to New Contributory Pension Scheme are some of the bold anti-workers steps taken by the New Government.
The National Council (Staff Side) when they met during October, 2014 at New Delhi it was unanimous opinion to pursue the issues through organizational methods. Accordingly, it was decided to hold a NATIONAL CONVENTION, eliciting the participation of the representatives of all Service organisations participating in the JCM to discuss the emerging situation and decide upon future course of action. Incidentally, we must mention that the JCM conceived as a negotiating forum has been made in-effective by the Government over the years by not convening its meetings periodically.
It was decided that the National Council Convention will be held at
Venue : MPCU Shah Auditorium, Sree Gujarati Samaj, Raj Niwas Road, Civil lines (Opposite Civil lines Metro Station), Delhi
Date : 11th December, 2014 from 12 noon to 16oo hrs.
150 Delegates from Defence Federations (INDWF and AIDEF) are permitted to participate.
Around 75 Delegates from INDWF have to participate and therefore all the Office Bearers and Working Committee members are invited to participate in the convention. Those who are participating are required to intimate to the undersigned so that the DelegatePasses/Badges on their names will be arranged to participate in the convention.
Treat this as an important matter which will decide the issues of 7th CPC (merger of DA and IR) as well as present trend of the New Government on the future of Central Government Employees particulars about Defence Civilian Employees.

Depts Ignoring DoPT Rules In RTI Matters: Notice Issued

Even nine years after enactment of the Right to Information Act, officials have been found to be rejecting applications with fee drawn in favour of ‘Accounts Officer’ as mandated by the Department of Personnel and Training (DoPT).

Taking a stern view against the practice, the Central Information Commission recently issued a show-cause notice to the Delhi Government for rejecting an RTI application on the grounds it was drawn in favour of “Accounts Officer” and not in favour of “Executive Engineer” as per their internal rules.
This is not the only case where application has been rejected. In a number of cases, public authorities like Army and Indian Air Force demand fee drawn as per their rules and do not follow the DoPT norms.
The application sought details of MPLAD funds and their expenses during the last five years on flood control measures. It was returned by the Irrigation Department claiming that name of the payee was wrong on the fee submitted by the applicant.
“The Commission directs Rajesh Singh, Executive Engineer: Civil Division:IV to show cause as to why penalty u/s 20 should not be imposed upon him for not accepting the IPO in the name of the Accounts Officer despite clear instructions from DoPT.
“He is directed to submit his response so as to reach the Commission within three weeks of receipt of this order,” Information Commissioner Sridhar Acharyulu said.
If the officer fails to explain the reason for rejecting the application, the Commission may penalise him at the rate of Rs 250 per day from the day the application was filed subject to a maximum penalty of Rs 25,000.
He also directed the PIO to ensure that while responding to the RTI application, the PIO should ensure that reference date is mentioned so that appellants do not find it difficult to link it to their RTI application.
“Department of Personnel and Training (DoPT) has repeatedly reminded public authorities to accept all payments under RTI Act made in ‘Accounts Officer’. But difficulties are being faced by RTI petitioners because of public authorities not complying with DoPT circulars,” RTI applicant Subhash Agrawal said.

It may be clarified that financial upgradations under MACPS would continue to be granted in the successive grade pay in the hierarchy of recommended revised pay band and grade pay as given in Section 1, Part-a of the first Schedule of the Railway Services (Revised Pay), Rules, 2008 and not in the promotional hierarchy, where functional promotion are allowed in the same Grade Pay, MACP benefits would also be regulated in the Grade Pay only.

The undersigned is directed to refer to AlRF’s letter No.AlRF/MACP/2014 (302), dated 07.10.2014 and to state the matter has already been consulted with DoP&T, the nodal department of Govt. on MACPS, and they have advised as under:

As regards the Order dated 31.05.2011 in CA No. 1038/CH/2010 (Raj Pal vs UOI) of Hon’ble CAT, Chandigarh which was upheld by the High Court and Apex Court, it may be stated that the Apex Court has not considered the issue on merit. The said SLP was dismissed due to insufficient explanation to condone the delay in the filing of the SLP. As regards implementation of CAT Order dated 9.5.2012 in GA No. 141/2012, the administrative Department was advised for implementation for the petitioners only subject to outcome of Review Petition in view of Contempt case. It may also be stated that generally the judgments passed by Hon’ble Tribunals/Courts are applicable/implemented to the specific case, unless there is any direction for similar dispensation to be extended to similarly placed persons. Hence, the above Orders pronounced favoring the applicants by the Tribunal/Courts and implemented on attaining finality or due to contempt or due to any other reason may be taken as exceptions/aberration.

In the matter, DOP&T have advised to maintain status quo with regard to the provisions for grant of MACPS benefits. It may be clarified that financial upgradations under MACPS would continue to be granted in the successive grade pay in the hierarchy of recommended revised pay band and grade pay as given in Section 1, Part-a of the first Schedule of the Railway Services (Revised Pay), Rules, 2008 and not in the promotional hierarchy, where functional promotion are allowed in the same Grade Pay, MACP benefits would also be regulated in the Grade Pay only.

Since, DoP&T is the nodal department on MACP Scheme and financial upgradation under the Scheme are regulated as per instructions/clarifications issued by them from time to time. In view of the above, it is not feasible to deviate from the instructions issued by the nodal deptt. on the subject viz. DoP&T.

AADHAAR BASED DIGITAL LIFE CERTIFICATE FOR CENTRAL GOVT PENSIONERS

Life Certificate for retired employees to be submitted in November every year.

Retired Central Government employees, pensioners and those drawing family pension will have to submit Life Certificates at the banks where they draw their pensions.

Until about a few years ago, pensioners had to go to their respective banks in order to withdraw their monthly pensions. Usually there would always be some clerical glitches or delays in distributing the pension funds causing immense hardship to the pensioners. In order to rectify this hurdle, the Government began distributing pension via ATM cards through their respective banks. Pensioners didn’t have to go to the banks anymore to collect their pensions. But, once every year, they are required to go to the banks in person, sign and withdraw the pensions.


From 2012 onwards, it has been made mandatory for pensioners to submit Life Certificates in revised format in the month of November. The banks have to be informed immediately if the pensioner dies. In order to avoid potential malpractices and cheatings, pensioners are asked to submit life certificates, in order to prove that they are alive.

Now, the Central Government has decided to introduce the life certificate to go with digital formation.

‘Jeevan Pramaan Scheme’ an Aadhaar card based digital life certificate for Central Govt Pensioners and family pensioners introduced by the Department of Electronics and Information.

The modern life certificate brings the details of the pensioner including biometric information. The complete data will be transfered to central database on real-time basis. According to the information received, pension disbursing agency to access digital life certificate. This will conclusively establish that the pensioner was alive at the time of authentication.

The software application system will be made available to pensioners and other stakeholders on a large scale at no extra cost. It can be operated on a personal computer or a smartphone, along with an inexpensive biometric reading device. This facility will also be made available at Common Service Centres being operated under the National e-Governance Plan, for the benefit of pensioners residing in remote and inaccessible areas.




WHEN MARRIED SON IS ELIGIBLE FOR COMPASSIONATE APPOINTMENT, WHY NOT A MARRIED DAUGHTER, ASKS MADRAS HC

CHENNAI: Why is it that a married daughter of a deceased government employee is not eligible for appointment under compassionate grounds while a married son is eligible, Madras high court has wondered. 

Ruling in favour of a complainant on Thursday, Justice D Hariparanthaman said: "There cannot be any discrimination between a married son and a married daughter.... Making discrimination between a son and a daughter on the ground of marriage is arbitrary and violative of fundamental right to equality." 


The matter relates to a writ petition filed by P R Renuka, stating that her father, an office assistant working in the animal husbandry department, died while he was in service in February 1998. He left behind his wife and three married daughters, besides an unmarried daughter.
